Please read these terms and conditions prior to using the Service. By using the Service, you agree to be legally bound by these terms and conditions, and our Privacy Policy, and Terms of Service. If you do not agree with these terms, please do not use the Service. Also note that to process your requests for this Service, you may be charged a fee to send and receive messages based on the terms of your wireless service. Msg & data rates may apply. PROMOTION PERIOD; DEADLINE FOR SUBMISSION OF ENTRIES: The Sweepstakes runs from November 5, 2016 through March 1, 2017 (the "Promotion Period"). Contest will open two hours prior to the published start time for each Xavier regular season home men’s basketball game. All entries must be received by 30 minutes following the published start time for each Xavier regular season home men’s basketball game to be included in the drawing.
ELIGIBILITY; PERSONAL INFORMATION: Open only to legal U.S. residents who, as of 9/1/16, are at least 18 years of age. Employees, officers and representatives of Meijer, Xavier University and Xavier Sports Properties (collectively, the “Promotion Entities”), as well as the immediate family (spouse, parents, siblings and children) and household members of each such person, are not eligible. Limit one entry per person, per e-mail address or mobile number, which is valid for the entire Promotion Period. No mechanically reproduced entries will be accepted. Personal information will be used in accordance with the website's Privacy Policy. The Promotion Entities may utilize each entrant’s personal information based on which opt-in(s) the entrant has selected to receive future email or text messages. All entries become the property of the Promotion Entities. Entries will be deemed as made by the authorized account holder of the telephone number or email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address or telephone number by an Internet access provider, online service provider, mobile service provider or other organization that is responsible for assigning email addresses, domains, or phone numbers associated with the submitted information.
DRAWING: One (1) prize winner will be selected by random drawing conducted by the Promotion Entities or their agent from all eligible entries received within the Promotion Period. Eligible entries are entries received in completion during the Promotion Period and that otherwise meet the requirements described in these Rules and Regulations. All drawings are final and binding on all matters related to the Sweepstakes. Winners need to be present at the drawing, and will be notified by text when their mobile number has been drawn. Upon notification, each winner must claim his or her prize by going to the Xavier Guest Services kiosk near the main entrance and show the text message to redeem! If a given winner does not respond within seven (7) days of initial notification, an alternate winner for such prize will be selected at random from among remaining eligible entries.
PRIZES: The following prizes will be awarded: one (1) Prize per home game of $100 value. Any tax on any prize and all expenses not expressly specified herein are the sole responsibility of the respective prize winner. There is a limit of one (1) prize per household or family. Each prize is non-transferable and may not be redeemed for cash by winner. The difference between any stated value and the actual value of a prize will not be awarded to the winner. No prize substitutions shall be permitted except at the Promotion Entities’ sole discretion. The Promotion Entities reserve the right to substitute a prize of equal or greater value should any featured prize become unavailable. Winners will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (together with any other documents that may be requested by the Promotion Entities), which must be returned along with valid proof of age within seven (7) days or an alternate winner for that prize may be chosen. If a winner is a minor in his/her jurisdiction of residence, the prize may be awarded in the name of, or to, the winner’s parent/legal guardian who must execute all documents and agree to all obligations and undertakings of the winner, both on behalf of himself/herself and the winner, or the prize may be forfeited and awarded to an alternate winner.
LIMITATIONS OF LIABILITY; RELEASE AND INDEMNIFICATION: The Promotion Entities are not responsible for any: (a) telephone, computer system, hardware, software, network or other technical failure, malfunction or error; (b) communication disruption or delays, including those related to or caused by Internet traffic, virus, bug, non-authorized intervention or human error; or (c) damage caused by computer virus or bug, resulting in damage to any computer or cell phone from an entrant’s access or the Sweepstakes Website. The Promotion Entities further are not responsible for printing or typographical errors in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible entries; or for transactions that are lost, misdirected, or fail to enter into the processing system, or that are processed, reported or transmitted late or incorrectly, or that are lost for any reason, including, without limitation, computer, telephone, paper transfer, or human error; or for electronic, computer, or telephonic malfunction or error. Each winner acknowledges that the Promotion Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. By participating in the Sweepstakes, each entrant agrees to indemnify and hold harmless all Sweepstakes Entities (defined as the Promotion Entities and all sponsors and administrators of the Sweepstakes, along with their respective parent entities and subsidiaries, affiliates, successors, assigns, directors, officers, employees, attorneys and agents) from and against any and all injuries, losses, damages, claims and actions of any kind arising from or relating to participation in the Sweepstakes, or acceptance, possession, use, misuse or nonuse of any prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages. By accepting a prize, each winner further releases all of the Sweepstakes Entities from any and all claims, liability, loss or damage arising out of or in connection with the awarding, receipt, possession and/or use or misuse of any prize or participation in any prize-related activity.
RIGHT TO CANCEL OR SUSPEND SWEEPSTAKES; DISQUALIFICATION: The Promotion Entities reserve the right, in their sole discretion, to cancel or suspend this Sweepstakes without advance notice should virus, bugs, technical malfunctions or other causes beyond the Promotion Entities’ control corrupt the administration, security or proper play of the Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom the Promotion Entities believe to be causing malfunction, error, disruption or damage, will be disqualified.
RIGHT TO USE NAME, PHOTO AND LIKENESS: By accepting a prize, each winner consents to the use of his/her name, photo and/or likeness in any and all media by the Promotion Entities for advertising and promotional purposes without additional compensation, except where prohibited.
GENERAL: Each person who participates in the Sweepstakes fully and unconditionally agrees to comply with and abide by these Official Rules and the decisions of the Promotion Entities, which shall be final and binding in all respects.

Xavier Athletics respects your privacy. We will only use information you provide to the Service to transmit your text message or as otherwise described in this document. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the Service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate, or incomplete, we may refuse you access to the Service and pursue any appropriate legal remedies.
