THIS SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE DISTRICT OF COLUMBIA AND THE UNITED STATES, EXCLUDING RHODE ISLAND, PUERTO RICO, THE US VIRGIN ISLANDS AND OTHER TERRITORIES, WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY, AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO A RESIDENT OF AN ELIGIBLE STATE AT THE TIME OF ENTRY. High school varsity athletes or a parent or legal guardian of a high school varsity athlete or the coach are not eligible.NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

By entering, each entrant grants TriHealth (“Sponsor”) and Administrator permission to use his/her information (name, email, phones, etc.) for future contact, except where prohibited by law. No information collected from this Sweepstakes will be sold to third parties or provided to any third party for use in connection with the marketing of the third party’s products/services.
1. How to Enter: To enter online, go to www.GoXavier.com/DriveToNYC and fill out the required registration information during the entry period, which begins at 12:00 A.M. (eastern time) on January 18, 2019 and ends at 11:59 P.M. (eastern time) on February 15, 2019. Administrator's computer is the official time-keeping device for the promotion. You many only enter once via one (not both) of the above described mediums.
Administrator will not verify receipt of entries. Automated entries are prohibited, and any use of such automated devices or programs will cause disqualification. Administrator and its advertising and promotion agencies are not responsible for lost, late, illegible, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic. Promotional entries are the property of Administrator and will not be returned.
2. Eligibility: Only open to legal residents of the United States, excluding Rhode Island, Puerto Rico, the US Virgin Islands and other territories,18 years of age or older at the time of entry. Void where prohibited or restricted by law. Employees of Administrator, Sponsor, and their respective affiliates, advertising and promotion agencies, judging organizations, and employees’ immediate families residing in the same household are not eligible. All federal, state and local laws and regulations apply. This promotion is intended for viewing in the United States only and shall only be construed and evaluated in accordance with United States law. You are not eligible to participate in this promotion if you are not located within and a legal resident of the United States or you reside in Rhode Island, Puerto Rico, the US Virgin Islands or other territories. You are not eligible to participate in this promotion if you are a high school athlete who participates in a varsity sport ("High School Athlete"), a parent or legal guardian of a High School Athlete or the coach of a High School Athlete. Limit one entry per person and per address.
3. Prize: One (1) winner will receive a trip for two (2) to the tournament championship of the conference in which Xavier University’s men’s basketball team participates, including two (2) tickets, airfare for two (2) and one (1) hotel room for two (2) nights. Total approximate retail prize value of $1300. Cash prize value is $1.00. No prize substitutions or cash redemption except as provided herein or at Sponsor’s or Administrator’s sole discretion.
Odds of winning a prize depend on the number of eligible entries received. No substitutions or transfers of prize(s) are permitted by the winners, except at the Sponsor’s or Administrator's sole discretion. All taxes and all other costs associated with acceptance or use of the above prize(s) are the sole responsibility of the applicable winner. Sponsor and/or Administrator reserve the right to substitute a prize of equal or greater value. ALL PRIZES ARE AWARDED “AS IS” WITH ABSOLUTELY NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, FROM SPONSOR OR ADMINISTRATOR. TO THE FULLEST EXTENT PERMITTED BY LAW, SPONSOR AND ADMINISTRATOR DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES IN CONNECTION WITH THIS SWEEPSTAKES AND ANY PRIZE.
4. Drawing and Awarding of Prize: Administrator will randomly select a winner. Winner will be notified by phone and/or email. Should winner not respond within two (2) days of notification, prize will be forfeited and awarded to an alternate winner.
5. RELEASE OF LIABILITY AND PUBLICITY: By entering, all entrants agree to be contacted by the Administrator and/or Sponsor regarding upcoming promotions. All entrants release Administrator, Sponsor and each of their respective affiliates, subsidiaries, franchisees, officers, directors, partners, equity holders, agents, employees, and all others associated with the development and execution of this Sweepstakes (collectively, the "Released Parties"), from any and all liability with respect to, or in any way arising from, this Sweepstakes and/or acceptance or use of the prize, including liability for personal injury, damages, death or monetary loss. The Released Parties assume no responsibility for any injury, loss or damage to entrants' or to any other person's computer relating to, or resulting from, entering or downloading any information or software in connection with this Sweepstakes. The Released Parties are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or late, failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user, or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any human or other errors that may occur in connection with this Sweepstakes. The Released Parties are not responsible for any damages or injuries incurred while traveling or attending the events related to the Prize hereunder, or otherwise utilizing the Prize, and entrant agrees to release and hold the Released Parties harmless from any such damages, claims or liability.
Entrants give the Released Parties permission to use their name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like (collectively, "Images"), taken or made in connection with entrants' participation in the Sweepstakes (including in connection with the use of any prize), and to modify, reproduce, display or otherwise disseminate such Images, in whole or in part. Entrants agree that the Released Parties have complete ownership of such Images including the entire copyright therein, and may use such Images for any and all purposes, including but not limited to using the Images in illustrations, bulletins, videotapes, reprints, reproductions, publications, advertisements, and any promotional materials in any medium now known or later developed, including the Internet, and entrants will take no action to challenge or object to the validity of such ownership. Entrants acknowledge that they will not receive any compensation for the use of such Images and hereby release and discharge the Released Parties from any and all claims which arise out of or are in any way connected with the use, display, dissemination or exploitation of the Images, including but not limited to any claims for defamation, violation of moral or artistic rights and/or any right of privacy or publicity. Entrant agrees to sign and execute additional releases, waivers and agreements as a condition to receive any Prize hereunder, and failure to execute any such documents within two days of any such request by any Released Party shall, unless otherwise agreed to in writing by the Released Parties, constitute a forfeiture of any Prizes won and the Prizes will be awarded to an alternate winner.
6. GENERAL RULES: : Each person who participates in the Sweepstakes fully and unconditionally agrees to comply with and abide by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects. The Released Parties are not responsible for lost, illegible, late, delayed or misdirected mail or email or other communications, or for any error in the printing or interpretation of the offer, the administration of the Sweepstakes, or in any announcement of the winners or prizes. In no event will Administrator be liable for more than the stated number of prizes in Section 3. No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable except at sole discretion of Administrator. Administrator reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes, in its entirety or in part, should tampering, unauthorized intervention, counterfeiting, fraud, technical failures, or other causes beyond Administrator's control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. Administrator reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement, or any other unfair playing practices, poor sportsmanship, or intending to annoy, abuse, threaten, or harass any other entrants or Administrator representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
7. INDEMNIFICATION: By entering this Sweepstakes, you as entrant also agree to release, hold harmless and indemnify Administrator and Sponsor from and against any and all claims arising directly or indirectly from or in connection with entrant's participation in the Sweepstakes.
8. APPLICABLE LAWS AND JURISDICTION: Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Texas. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Dallas, Texas. Should there be a conflict between the laws of the State of Texas and any other laws, the conflict will be resolved in favor of the laws of the State of Texas. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
9. ABBREVIATED RULES: Sweepstakes open to legal residents of the United States 18 years of age & older at time of entry except employees and immediate family of Administrator and Sponsor, High school varsity athletes and their immediate family and coaches. Entry period begins at 12:00 A.M. (eastern time) on January 17, 2019 and ends at 11:59 P.M. (eastern time) on February 15, 2019. No purchase necessary. Void where prohibited.
